Terms and Conditions
Welcome to PC Village. Please read these terms and conditions of use carefully before using this website. The following terms and conditions govern the sale of products by PC Village. Each time you submit your order to PC Village, you signify your acceptance and agreement to be bound by these terms and conditions.
Order Acceptance Policy
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. PC Village reserves the right at any time after receipt of your order to accept or decline your order for any reason. All orders must be pre-approved with an acceptable method of payment before shipment occurs. We may need additional information for verification purposes before we accept any order.
Payment Terms
Payment may be made by credit card, online bank payment, certified cheque, money order or bank draft. Once an order is placed by credit card, the credit card account will be verified at the time the order is placed. Orders are processed ONLY upon receipt of payment.
Prices
All prices appearing on pcvonline.com are quoted in Canadian dollars, and do not include the applicable taxes unless otherwise noted. The prices do not include shipping and handling. The price charged for an order will be the price in effect at the time the order is made.
Shipping and Handling Charges and Taxes
The buyer is responsible for all applicable charges including but not limited to: shipping, handling, delivery, taxes and applicable tariffs associated with the purchase.
Risks during Shipping
When PC Village ships the product, our liability for damage or breakage on the shipment will be limited to the coverage provided by the carrier's terms and conditions. You may wish to purchase additional insurance coverage for the full value of the product when you order.
Typographical Errors
In the event a PC Village product or service is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, PC Village shall have the right to refuse or cancel any orders placed for product or service listed at the incorrect price. PC Village shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, PC Village shall issue a credit to your credit card account in the amount of the incorrect price.
Limitation of Liability
The maximum liability to you for products purchased from PC Village shall be limited to the purchase price you have paid for the products. Also, PC Village will not be liable for any property damage, personal injury, loss of use, interruption of business, loss of profits, or other consequential, indirect, incidental, punitive or special damages. This applies to all situations however caused, whether for breach of warranty, contract, tort (including negligence), and strict liability or otherwise, other than those damages that are incapable of limitation, exclusion or restriction under applicable law.
Title
Title to Products passes from PC Village to you upon shipment by PC Village. Title to Software remains with the applicable licensor(s) of the software.
Interpretation
These terms and conditions shall be interpreted under and governed by the federal laws of Canada, without giving effect to conflict of laws rules. The headings used in these Terms and Conditions are for reference purposes only and are not intended to be part of or affecting the meaning of these Terms and Conditions.
No Modification
Any additional or altered terms attached or appended to an order shall be null and void, without effect unless agreed to in writing by PC Village. These Terms and Conditions may not be modified, altered or amended without the written agreement of PC Village.
Severability
If any provision of these Terms and Conditions is held to be illegal, invalid or un-enforceable, in whole or in part, the legality, validity and enforceability of the remainder shall not be affected nor impaired. The Terms and Conditions stated herein are declared to be Severable.
Assignment
This agreement with PC Village cannot be assigned without PC Village's written authorization. PC Village is the intended beneficiary of this agreement. If there is any inconsistency between this agreement and other information or agreements included or relating to products purchased from PC Village, this agreement will take precedence.
Linking and Framing of this website
Links to this website without the expressed permission of PC Village are strictly prohibited. We reserve the right to cancel or revoke any permission given to link to our site at any time for any reason, without any notice without liability to you or any other person. Framing of this website or any of its content in any form or by any method is strictly prohibited.
